These Terms of Service ("Terms") govern the use of the web application ("Application") available at quijbo.com, which is provided by Ing. Tomáš Zacha, ID: 01169483, Křenova 254/2, Prague 6 ("Provider"). By using this Application, you agree to comply with these Terms.
1. Service Description
The Application allows users to create personalized memes by uploading images and adding custom text with personalized names. All memes created by users can be downloaded and shared. Users are fully responsible for the content they upload and create through the application.
2. Users
Each user must be at least 18 years old or have the consent of a legal guardian to use the Application. Users agree not to use the application for illegal purposes or activities that violate these Terms.
3. Prohibited Content and Activities
Users must not upload content or create memes that:
- Are of an erotic, pornographic, or inappropriate nature
- Incite hatred, discrimination, or are racist
- Contain false or fraudulent information
- Publish protected personal data of third parties without their consent
- Violate copyright or other intellectual property rights
- Promote illegal or unethical activities, including the dissemination of malware or phishing
- Misuse the system for spam, bulk messaging, or unsolicited commercial activities
The Application reserves the right to remove any content that violates these Terms and block access to users who repeatedly break the rules.
4. Responsibility for Content
Users are solely responsible for the content they upload and the memes they create, including any copyrighted materials, images, or text. The Application and its provider are not responsible for user-generated content or any claims arising from such content.
5. Use of User Data
Images and data uploaded to the Application may be temporarily processed for meme generation purposes. The Application does not permanently store user uploads beyond the creation process. By using the Application, users grant the Application the right to process their uploaded content solely for meme generation purposes.
6. Intellectual Property
Users retain ownership of their original content. However, users are responsible for ensuring they have the right to use any uploaded images or text. The Application provides tools for content creation but does not claim ownership of user-generated memes.
7. Changes to Service and Terms
We reserve the right to update or change these Terms and the features of the Application at any time without prior notice. The current version of the Terms will always be available on our website. Continuing to use the Application after changes to the Terms indicates that you accept these changes.
8. Disclaimer of Liability
The Application provides its services "as is" without any warranties, express or implied. We do not guarantee uninterrupted functionality, accuracy of content, or protection against possible cyberattacks. Using the Application is at the user's own risk.
9. Immediate Service Termination
The provider of the Application reserves the right to immediately terminate or disable access to the service without prior notice for any reason, particularly if a violation of these Terms is detected or inappropriate or prohibited content is uploaded.
10. Service Termination
We reserve the right to terminate access to the Application for any user without prior notice in case of a violation of these Terms or other legal regulations.
11. Governing Law
The use of this Application and these Terms is governed by the law of the Czech Republic. Any disputes relating to the Application will be resolved by the courts of the Czech Republic.
